Abstract:
The commercial value of personality traits is an existing and tradable social phenomenon. The economic value of personality was already recognised in Hungarian legal literature at the beginning of the 20th century, and the existence of economic value can be deduced from the provisions of the Civil Code in force.
The German legal system already recognised the social need for this, but in our country – presumably because of the socialist conception of society – legislation may seem somewhat belated, but by recognising the transferability of personality traits between living persons, the legislator would probably create more problems than it would solve.
